In certain situations, engaging a Special Judge offers a number of advantages over traditional arbitration or trial. Both parties agree to hire a qualified former judge who served within the last 4 years in district or county court to preside over all or a portion of the parties dispute. Special Judges conduct trial in the same manner as a court trying an issue without a jury. After hearing all evidence and argument of counsel a Special Judge may render a verdict and this judgement may be appealed as any other judgment of a district or county court.

While this method of dispute resolution has been available for over 25 years, even many experienced attorneys in Texas are not aware of this option. Use of a Special Judge offers an additional layer of confidentiality to the parties involved as well as the ability to agree upon a judge with specialized knowledge in a subject area.
